1.  The Mare Owner and Bar~On Ranch agree to breed the above named mare to Skippoleon AQHA #4606741 for a Breeding Fee of $750.00 during  the 2008 breeding season.   A non-refundable deposit of $250 is payable upon execution of this breeding contract. This fee will be applied towards the breeding fee. The remainder of the breeding fee is payable prior to any shipment of semen.

2.  In addition, a Collection and Handling Fee of $175.00 is charged for each semen shipment for the attending veterinarian and our expenses for the timing arrangements, semen collection, evaluation, processing, packaging, handling, and delivery of the semen shipment to the express shipper or  Salt Lake International airport.

3. The Shipping Cost for the semen must be paid by the mare owner.  Depending on the mare owners shipping needs, the shipment will either be shipped UPS, FedEx Over Night or by same day air shipment, and will be charged to the Mare Owner. A fee of $35.00 will be charged in addition to the shipping fee for airport delivery, if such delivery is required.

4.  Bar~On Ranch can use a Permanent Shipping Container (Equitainer). The mare owner shall pay a $300.00 refundable deposit. There is a $50.00 late fee, if the Equitainer is not returned and received by Bar~On Ranch within six days (6) of semen shipment, and a $250.00 replacement fee if the container is not received within seven days (7) of semen shipment, or is not returned in reusable condition.  Return shipping  costs and $300 insurance on the Equitainer  shall be paid by the Mare Owner  and is not charged with or included in the above fees.   The Equitainer deposit shall be returned to the Mare Owner as soon as the mare is checked in foal by a licensed veterinarian, or the end of the breeding season, whichever comes first. A Equine Express disposable container is also available for a cost of $35.00.

5.  The Mare Owner shall contact Bar~On Ranch at least two weeks before the approximate insemination time and notify Bar~On Ranch of the name, express mail address, and day/evening phone of the veterinarian which the Mare Owner has selected as their agent to perform the insemination of the mare.  The Mare Owner agrees Bar~On Ranch  will ship the cooled semen to this licensed veterinarian.  After receiving notification  from the Mare Owner, 
Bar~On Ranch will research the final shipping details and prepare the pre-shipping bill.  The remainder of the breeding fee, the collection and handling fees, the shipping costs, and the container deposit are then billed and become due.  No semen will be shipped unless this pre-shipping bill is paid. 

6.  The Mare Owner's veterinarian, acting as the agent for the Mare Owner, shall order the cooled semen shipment as early as possible, but no later than the Bar~On Ranch order schedule.  Semen collections and shipments are performed on an every other day schedule.  Semen arrivals depend on the shipping company, but are scheduled for any day except  Sundays.  Sundays will require airport service.  Depending on availability, each semen shipment will contain one or two bags of semen for insemination during the same heat cycle.  The semen shipment is accompanied by a "AQHA Cooled Semen  Transportation  Certificate" for AQHA registered mares, or an "APHA Collection Certificate" for APHA registered mares.  

7.  Should the mare not settle from the first shipment's  inseminations, additional semen shipments will be provided by Bar~On Ranch.  The Breeding Fee will not become due again.  However,  the Collection and Handling Fee and Shipping Costs will be charged for each shipment.

8.  Should the mare not settle during  the 2008  breeding season,  abort, or not have a live foal  (standing or nursing),  the Mare Owners will be entitled  to one free re-breeding during the following year only for the same mare.  Only the Breeding Fee is free, all other fees apply.  The guarantee is complete with the mare being checked in foal after re-breeding.  The following conditions apply for a re-breeding guarantee:

     A.  Bar~On Ranch shall be notified of the aborting, or death of the foal within two days by phone or within one week in writing. 

     B. This notice shall be accompanied by a signed statement  from a licensed veterinarian stating the loss of pregnancy or death of the foal and that the foal did not stand and nurse prior to death. 

     C.  The mare shall be re-checked in foal by a licensed veterinarian between 45 and 60 days after the last breeding date.  Bar-On Ranch must be notified in writing of the mare's pregnancy condition.  

     D.  The mare shall  receive Rhino vaccinations at 5, 7 and 9 months of pregnancy.

9.    Bar~On Ranch is responsible for making delivery arrangements to have semen delivered to the Mare Owner's veterinarian.  Semen will have been checked viable after  being extended and before packaging.  Bar~On Ranch is not responsible for the handling process after it leaves the Bar~On Ranch.   If for any reason an additional shipment is required, all normal fees shall apply.  The Mare Owner bares all risks of loss or damage to the mare whether by death, disease, injury, infection or otherwise and by any cause whatsoever, including inappropriate, untimely or negligent inseminations or failure of insemination.  The Mare Owner therefore releases, discharges, indemnifies, and holds Bar~On Ranch harmless from any liability for any and all damages associated therewith.  The Mare Owner agrees to pay all expenses and attorney's fees incurred by Bar~On Ranch in defending any claims for which the Mare Owners have agreed to release, discharge, indemnify, and hold Bar~On Ranch harmless.

10.  The Mare Owner agrees to have only the mare, which is named in this contract, inseminated with the shipped semen, covered by this contract.  The Mare Owner will provide  Bar-On Ranch with a photocopy of the completed and signed AQHA or APHA  "Insemination Certificate" within 15 days from the last date of insemination.  The Mare Owner agrees to have the mare pregnancy checked by a licensed veterinarian as soon as possible, and will notify Bar~On Ranch when the mare is checked safe in foal.  A Transported Semen Breeder's Certificate will be issued by Bar~On Ranch to the Mare Owner after all expenses have been paid in full and upon notification of the birth of the foal.

11.  Should the above referenced stallion die or becomes unfit for breeding prior to Mare Owner getting a live foal from this breeding,  Mare Owner will receive a refund for breed fee plus booking deposit only, if already paid  

12.  The breeding season shall be from February 1 until July 31.

13.  This contract is governed by the laws of the State of  Utah.

14.  Additional Conditions:

BY SIGNING THIS CONTRACT I AGREE  WITHOUT EXCEPTION TO ABIDE BY THE STIPULATIONS OF THIS CONTRACT.
